DSA Recital 35

This Regulation respects all fundamental rights and observes the freedoms and principles recognised by the Charter of Fundamental Rights of the European Union, notably the freedom to conduct a business, the right to property, including intellectual property, the freedom of expression and information, the right to the protection of personal data, the right to respect for private and family life and the right to an effective remedy and to a fair trial, as well as cultural and linguistic diversity. Any restrictions on those rights and freedoms should be in accordance with Article 52(1) of the Charter of Fundamental Rights of the European Union, meaning that any restriction on the exercise of these rights and freedoms must be provided for by law and respect the essence of those rights and freedoms. Subject to that requirement, restrictions may be made to those rights and freedoms only if they are necessary and genuinely meet objectives of general interest recognised by the Union or the need to protect the rights and freedoms of others, including the protection of consumers, the protection of minors and safeguarding public security.
