In order to ensure adequate transparency of restrictions and to promote the consistent, diligent and objective application of any policies applied by providers of intermediary services, such providers should communicate clearly, in plain and intelligible language and in an easily accessible and publicly available format, information on any restrictions that they may impose on the use of their service, including, where relevant, the use of automated means of content moderation or algorithmic decision-making. Such requirements should be understood as applying to restrictions where the provider applies that restriction systematically. Providers of hosting services should, in their terms and conditions, also provide information on the procedures, if any, that they apply to notify and remove or disable access to content. Providers of online platforms should, in addition, make available information on their content moderation policies and procedures, including algorithmic decision-making and human review, as well as on the rules of procedure of their internal complaint handling system. This information should include user-friendly information on the right of recipients of the service to an effective remedy and the possibilities to seek redress as provided by this Regulation. In addition, such providers of online platforms should publish their terms and conditions, in each official language of the Member States in which they offer their services. Where providers of online platforms are required under this Regulation, or have chosen on a voluntary basis, to ensure that their terms and conditions are easily available and allow for easy consultation, including as concerns the plain and intelligible language requirement, such providers should ensure that their terms and conditions are drafted in a way that allows for their identification, consultation and for recipients of the service to be appropriately informed of their rights and obligations. To that effect, providers of online platforms could, for example, provide such information in frequently asked questions (FAQ) or in dedicated user guides. Where providers of online platforms modify their terms and conditions, including in respect of the grounds on which they may remove or disable access to information provided by recipients of their services, or suspend or terminate the provision of the service to recipients, they should inform the recipients of their service thereof, clearly distinguishing, where relevant, between material amendments and changes which do not have material effects. Providers of online platforms should notify recipients of such intended modifications before they enter into force, so that recipients can understand the consequences of the changes and are, if they do not agree with them, able to terminate their contractual relationship during a specified, reasonable period.
