The legal or natural person designated by a provider of intermediary services as its legal representative should be mandated to act on behalf of, and be contacted in addition to or instead of, the service provider on all issues necessary for the application of this Regulation, including compliance with orders and decisions, and receipt of other communications from the competent authorities. That legal representative should be empowered to comply with the orders or decisions, including compliance with the relevant obligations laid down in this Regulation. Member States should have the right to initiate proceedings, if necessary, including ensuring the enforcement of orders or decisions adopted in the exercise of enforcement powers, against the legal representative in situations where a third country provider does not comply with its obligations under this Regulation. This should be without prejudice to the possibility for Member States and other parties with a legitimate interest, to initiate proceedings against the provider itself, irrespective of whether that provider has designated a legal representative.
